Terms and Conditions of Sale (CGV)
1. Scope
These Terms and Conditions of Sale ("Terms") govern all purchases made through the e-commerce website operated by hanafiab ("the Seller", "we", "us", or "our"). By placing an order on this website, you ("the Customer") agree to be bound by these Terms.
2. Products
The products offered for sale are those described on the website at the time of consultation. We make every effort to ensure that product descriptions, images, and specifications are accurate. However, minor variations may occur.
3. Prices
All prices are displayed in the currency indicated on the website and include applicable taxes unless otherwise stated. Shipping costs are indicated separately before order confirmation.
hanafiab reserves the right to modify prices at any time. However, products will be invoiced based on the price in effect at the time of order confirmation.
4. Orders
To place an order, the Customer must follow the online ordering process and provide accurate and complete information.
An order is considered final once payment has been successfully processed and an order confirmation email has been sent. hanafiab reserves the right to refuse or cancel any order in case of suspected fraud, payment issues, or breach of these Terms.
5. Payment
Payments are processed securely via Stripe and other payment methods displayed on the website. By providing payment information, the Customer represents and warrants that they are authorized to use the chosen payment method.
All transactions are encrypted and processed in compliance with applicable payment security standards. hanafiab does not store full payment card details.
6. Delivery
Products are delivered to the address provided by the Customer during checkout. Delivery times are estimates and may vary depending on the destination and carrier.
hanafiab is not responsible for delays caused by carriers, customs clearance, or force majeure events. Risk of loss or damage transfers to the Customer upon delivery.
7. Right of Withdrawal
If the Customer is a consumer residing in a jurisdiction that provides a statutory withdrawal right (such as the European Union), they have the right to withdraw from the contract within fourteen (14) days from the date of receipt of the goods, without giving any reason.
To exercise this right, the Customer must notify hanafiab in writing within the withdrawal period. Products must be returned in their original condition and packaging. Return shipping costs are borne by the Customer unless otherwise required by law.
Refunds will be processed within fourteen (14) days after receipt and inspection of the returned goods, using the original payment method.
8. Guarantees
Products benefit from legal guarantees of conformity and against hidden defects in accordance with applicable consumer protection laws.
If a product is defective or non-conforming, the Customer must contact hanafiab promptly with supporting evidence (e.g., photos). Depending on the situation, we may offer repair, replacement, or refund in accordance with applicable law.
9. Complaints
Any complaints must be submitted in writing via the contact details provided on the website. Customers are encouraged to provide their order number and a detailed description of the issue.
hanafiab will make reasonable efforts to respond to complaints within a reasonable timeframe.
10. Limitation of Liability
To the fullest extent permitted by law, hanafiab shall not be liable for indirect, incidental, or consequential damages arising from the purchase or use of products.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
11. Data Protection
Personal data collected during the ordering process is processed in accordance with our Privacy Policy. Payment data is processed securely by Stripe in compliance with applicable data protection and payment security regulations.
12. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the country in which hanafiab is established, without regard to conflict of law principles.
In the event of a dispute, the parties will seek an amicable resolution. Failing this, disputes shall be submitted to the competent courts in accordance with applicable law.
